Welcome to Callable*.

These Terms of Use and Terms of Service (collectively, “Terms”) govern your access to and use of the Callable* platform, website, and related services (collectively, the “Services”). By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services.

Callable* reserves the right to update and revise these Terms at any time to reflect changes to our Services, technology, and applicable laws. We will notify users of material changes where appropriate. Continued use of the Services after such updates constitutes acceptance of the revised Terms.


Terms of Use

Eligibility and Geographic Scope

You must be at least 18 years old to use our Services. Our Services are currently available only to residents of the United States. By accessing or using the Services, you confirm that you meet these eligibility requirements and have the legal capacity to enter into these Terms.

Community Guidelines

Users are encouraged to follow our Community Guidelines to foster a safe, respectful, and meaningful environment for all participants.

Account Registration and Responsibilities

You may create an account to access and use the Services. You agree to provide accurate and complete information when registering and to maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account. If you are registering on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Acceptable Use and User Conduct

To maintain a secure and constructive environment on Callable*, you agree to use the Services responsibly. We strictly prohibit any content or behavior that falls into, but not limited to the categories below.

1. Safety and Human Dignity You may not use the Services to generate, upload, or share content that:

  • Exploits Minors: Constitutes sexual exploitation, abuse, or grooming of minors, or contains any imagery depicting child sexual abuse.
  • Promotes Hate and Harassment: Engages in hate speech, discrimination, or violence based on race, ethnicity, gender, religion, age, disability, or other protected characteristics. This includes bullying, sexual harassment, or abusive language.
  • Encourages Self-Harm: Glorifies, encourages, or provides instructions for self-injury, suicide, eating disorders, or body-shaming.
  • Depicts Extreme Violence: Contains realistic, graphic, or gratuitous violence against people or animals, or promotes terrorism and violent extremism.
  • Is Sexually Explicit: Contains pornography or obscene material.

2. Integrity, Authenticity, and Rights You must respect the rights of others and the truth. You agree not to:

  • Infringe Rights: Submit content that violates the intellectual property, privacy, or publicity rights of any third party.
  • Impersonate: Misrepresent your identity or affiliation with any person or entity.
  • Defame: Publish content that is libelous, defamatory, or verifiably false with the intent to harm.
  • Misuse Voice and Likeness:
    • Clone or simulate the voice or likeness of a real person (including celebrities) without their explicit consent.
    • Create "deepfakes" or impersonations used for political misinformation, fraud, scams, or to damage a third party’s reputation.
    • Use a person's name or persona commercially without permission, outside of protected contexts like parody.

3. System Security and Technical Abuse You generally agree not to interfere with the technical operation of the platform. You must not:

  • Disrupt Services: Introduce viruses, malware, or code intended to damage or limit software, hardware, or telecommunications equipment, or disrupt the servers and networks connected to Callable*.
  • Scrape Data: Harvest email addresses, contact information, or other user data via automated means (spiders, robots, scrapers) or solicit personal data from minors.
  • Bypass Security: Attempt to evade technological protection measures, access unauthorized data, or reverse engineer, disassemble, or decompile the Service’s source code (except where expressly permitted by open-source licenses).
  • Commercialize: Lease, sell, sublicense, or unauthorizedly monetize the Services.

4. Regulated Activities and Malicious Conduct You may not use Callable* for:

  • Illegal Acts: Facilitating criminal activity, including the sale or purchase of illegal drugs.
  • Spam: Sending unsolicited promotions, junk mail, chain letters, pyramid schemes, or unauthorized advertising.
  • Professional Advice: Purporting to provide qualified medical, legal, financial, or tax advice.
  • Automated Decisions: Facilitating fully automated decision-making processes that create binding legal obligations or negatively impact a person’s legal rights.

5. General Discretion and Mission Alignment Callable* reserves reserves the right to prohibit any content or behavior that, in our sole judgment:

  • Is inconsistent with the Callable mission, values, or intended user experience;*
  • Is objectionable or restricts others from using or enjoying the Services; or
  • May expose Callable* or its users to any harm or liability.

Content Moderation and Enforcement

Callable* retains the full authority to investigate and take action against violations of these Terms. If we conclude, at our sole discretion, that you have breached these rules, we may:

  • Restrict the visibility of your content;
  • Remove your content, knowledge base, or profile permanently;
  • Suspend or terminate your account and access to the Services; and
  • Report your activities to relevant law enforcement authorities.

We utilize a combination of manual review and automated detection tools to identify non-compliant content and illegal activities.

Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy and our compliance with the California Consumer Privacy Act (CCPA). By using the Services, you consent to our data handling practices, including the processing and structuring of your uploaded knowledge base to enable retrieval during calls.

When you submit a DMCA Takedown Request form, we automatically record your IP address, device information, and the date and time of submission. This information is retained for the duration of the applicable statute of limitations and may be used for legal compliance, fraud prevention, and abuse mitigation.

Intellectual Property and Content Ownership

You retain full copyright and ownership of all content you upload, including knowledge bases, documents, and voice samples. Callable* does not claim any ownership rights to your content. By submitting such content, you grant Callable* only a limited, worldwide, royalty-free, non-exclusive, sublicensable, revocable license to process, transform, and use it solely for the purpose of providing, improving, and securing the Services.

Content License Terms:

  • All content licenses are revocable upon account deletion
  • We will remove your profile, knowledge base, and voice embeddings within 30 days of account closure
  • Retention beyond 30 days only occurs where required by law or with your explicit consent

Voice Processing:

  • By uploading voice samples, you grant us a limited license to process them into voice embeddings solely for operating your Callable* persona
  • Raw voice recordings are deleted immediately after processing
  • Voice embeddings are mathematical representations that cannot recreate your original voice
  • This license is revocable - deleting your account removes all voice embeddings

Knowledge Base:

  • Our system restructures and indexes your content but does not distribute the original material publicly
  • You may edit your knowledge base at any time
  • If you do not wish specific information to be used, omit it from your uploads
  • All profiles and associated data are deleted within 30 days of account closure, regardless of popularity

User Content Warranties and Indemnification

By uploading content to Callable*, you represent and warrant that:

  • You own all rights, title, and interest in the content you upload, or have obtained all necessary permissions from the rightful owners
  • Your content does not infringe any third-party copyrights, trademarks, patents, trade secrets, or other intellectual property rights
  • You have the full legal right and authority to grant us the licenses described in these Terms
  • Your content does not violate any applicable laws, regulations, or third-party rights
  • Your content complies with our Community Guidelines and acceptable use policies

Indemnification: You agree to indemnify, defend, and hold harmless Callable* and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your breach of these warranties and representations
  • Any third-party claims that your content infringes their intellectual property or other rights
  • Your violation of any law or third-party rights in connection with your use of the Services
  • Any content you upload or submit through the Services

We reserve the right to remove any content that we believe may infringe third-party rights or violate these Terms.

AI Responses and Interpretation

Callable* personas are created by real people through their knowledge base submissions. During calls, our AI retrieves information from the knowledge base to generate responses. The system does not invent facts or access the internet, but responses may occasionally misinterpret or combine information. You should not rely on Callable* responses for critical decisions.

Section 230 Protection for Creators: Creators of Callable* profiles are users of an interactive computer service. To the fullest extent permitted by law, including Section 230 of the Communications Decency Act (47 U.S.C. § 230), creators shall not be treated as the publisher or speaker of any information provided by another information content provider, including content independently generated by the AI personality that was not explicitly present in the creator’s uploaded knowledge base.

Data Deletion and Account Termination

Upon account deletion:

  • All content licenses granted to Callable* are automatically revoked
  • Your profile, knowledge base, and voice embeddings will be deleted within 30 days
  • Payment records are retained as required for tax and legal compliance
  • You may request immediate deletion by contacting privacy@callable.com.ai

Third-Party Services

Our Services may reference or integrate third-party content or services. We are not responsible for third-party practices, and your interactions with them are governed by their terms and privacy policies.


Terms of Service

Service Description

Callable* allows users to:

  • Create a Callable* persona by uploading a knowledge base, voice sample, and profile details.
  • Subscribe to call and converse with any available Callable* personas using calling credits.

Our platform functions like a creator-based network. Users are the creators of their personas, and engagement is based on the originality and quality of their knowledge base.

Subscriptions and Payments

Subscriptions provide calling credits, which are consumed per second during calls. Credits do not roll over. By providing payment details, you authorize Callable* to charge for the applicable fees and taxes. All fees are non-refundable except as required by law. Prices may change with notice.

Verification, Rewards, and Revenue Sharing

Users may optionally verify their Callable* persona. Only verified Callables are qualified for the revenue sharing program. Verification increases trust, prevents impersonation, and enables participation in rewards. These programs, including percentage allocations and reward structures, are subject to change with prior notice to participants.

Medical, Legal, and Professional Disclaimers

Callable* personas do not provide medical, legal, financial, or professional advice. You should always seek qualified professional guidance for such matters.

Enforcement and Termination

Callable* may remove content, suspend, or terminate accounts that violate these Terms, pose security or legal risks, or remain inactive for an extended period. Upon termination:

  • Access to Services will cease immediately
  • Profiles will be deactivated
  • All content and voice embeddings will be deleted within 30 days
  • Content licenses are automatically revoked
  • Exceptions apply only for legal compliance requirements

Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us. These Terms are governed by the laws of the State of California, unless preempted by federal law. For users outside the EU/UK, disputes may be subject to binding arbitration rather than litigation, except where prohibited by law.

Limitation of Liability

The Services, Outputs, and Actions are provided on an "as is" and "as available" basis and, to the fullest extent permissible under applicable law, are provided without warranties of any kind, whether express, implied, or statutory.

Callable* disclaims all warranties and is not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid in the twelve months preceding the claim.

Survival

Provisions related to intellectual property, content licenses, disclaimers, limitations of liability, indemnification, and dispute resolution survive termination of these Terms.
